1. Acceptance of Terms

By engaging our consultation services, you (“Client”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, please do not use our services.

2. Services Provided

We offer professional consultation services in the area of real estate investment. Our services may be provided via in-person meetings, phone calls, video conferences, email, or other agreed methods.

3. Client Responsibilities

You agree to:

  • Provide accurate, timely, and complete information as requested;

  • Be available at scheduled times;

  • Fulfill payment obligations as outlined below.

4. Fees and Payment

  • Fees for services are outlined in your proposal or invoice.

  • Payment is due before, during, and/or after receipt of invoice as specified in the contract terms.

  • Accepted payment methods include credit card, debit card, or bank transfer.

  • Late payments may incur a [percentage]% late fee as per contract specification.

5. Cancellations and Refunds

  • Appointments must be cancelled or rescheduled with at least [24/48] hours’ notice.

  • Cancellations made with insufficient notice may be charged a cancellation fee or the full session cost.

  • Refunds, if applicable, are at our sole discretion and will be issued within 10 business days.

6. Confidentiality

We agree to keep all client information confidential and not disclose it to third parties, except as required by law or with your written consent. You agree not to disclose any proprietary materials or methods provided during consultation.

7. Intellectual Property

All materials provided during the consultation, including reports, strategies, and resources, remain the intellectual property of KMJD ESTATES unless otherwise agreed. You may use them solely for personal or internal business purposes.

8. No Guarantees

Our consultation services are intended to support and guide your decisions, but we do not guarantee specific results or outcomes. You are responsible for any actions taken based on our advice.

9. Limitation of Liability

To the fullest extent permitted by law, KMJD ESTATES shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of our services.

10. Termination

We reserve the right to terminate our services at any time if you breach these Terms or behave inappropriately. You may also terminate services with written notice, subject to the cancellation policy above.

11. Governing Law

These Terms are governed by the laws of your state, both local and federal. Any disputes shall be resolved in the courts for Jurisdiction.

12. Amendments

We may update these Terms from time to time. Updates will be posted on our website or communicated via email. Continued use of services after changes constitutes acceptance of the new Terms.

Mobile Terms of Service

 

The mobile message service from kmjdestates.com (the “Service”) is operated by KMJD ESTATES (“kmjdestates.com,” “we,” or “us”). Your use of the service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of them.

By consenting to kmjdestates.com’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of kmjdestates.com through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders, appointments, and newsletter subscriptions).

You understand that you do not have to sign up for this program to make any purchases, and your consent is not a condition of any purchase with kmjdestates.com. Your participation in this program is completely voluntary.

We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of the service at any time. Text the single keyword command STOP to 941-298-5334 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. We will not send any further messages to your mobile device unless you initiate them. If you have subscribed to other kmjdestates.com mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and any action you may or may not take in reliance on the information or Service.
